1. Acceptance of Terms
By downloading, installing, or using ProofSafe ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms apply to all versions of ProofSafe, including the free tier and Premium subscription.
2. Who Can Use ProofSafe
You must be at least 13 years old to use ProofSafe. By using the App you confirm that you meet this requirement. If you are under 18, you must have parental or guardian consent.
ProofSafe is intended for lawful personal, professional, and commercial use. You are responsible for ensuring your use complies with all applicable laws in your jurisdiction.
3. Permitted Use
You may use ProofSafe to:
- Capture, organise, and manage evidence for legitimate personal or professional purposes
- Generate certificates and reports for your own use or to share with relevant parties
- Register evidence with the ProofSafe server to obtain timestamped proof of existence
- Verify evidence registered by yourself or others via the public verification portal
4. Prohibited Use
You must not use ProofSafe to:
- Capture, store, or distribute content that is illegal in your jurisdiction
- Photograph or record individuals without their knowledge where consent is required by law
- Fabricate, stage, or misrepresent evidence
- Register false or misleading evidence with the ProofSafe server
- Attempt to reverse-engineer, decompile, or tamper with the App
- Use the App or its API in any way that could damage, overload, or impair our servers
- Violate the privacy rights of any individual
5. Evidence and Legal Admissibility
ProofSafe provides technical mechanisms — SHA-256 file verification, GPS capture, timestamps, and server registration — that are designed to support the authenticity of evidence. These mechanisms are referenced in internationally recognised standards including FRE 901(b)(9), FRE 902(13)-(14), and eIDAS Regulation EU 910/2014.
However, we make no guarantee that evidence captured with ProofSafe will be accepted by any court, arbitrator, insurer, or other authority. Admissibility depends on the laws and rules of evidence in your jurisdiction and the discretion of the relevant decision-maker.
Imported files are clearly labelled as "Imported" and their Verification ID reflects file integrity from the point of import — not the original moment of creation.
6. Free Tier and Premium Subscription
Free tier: The free version of ProofSafe is supported by advertising and includes usage limits (currently 3 active cases, 10 items per case, 5 registrations per month, 3 imports per month). These limits may change with notice.
Premium subscription: Premium removes limits and ads, and adds PDF certificates, case reports, and Google Drive backup. Subscriptions are billed through Google Play. You may cancel at any time via your Google Play subscription settings. Refunds are subject to Google Play's refund policy.
We reserve the right to modify the features included in each tier with reasonable notice.
7. Server Registration Service
The online evidence registration service stores a mathematical fingerprint of your evidence (not the file itself) on our servers. This service is provided on a best-efforts basis. We do not guarantee:
- Uninterrupted availability of the registration or verification servers
- Permanent retention of registered evidence records
- Legal acceptance of server registration as proof in any jurisdiction
Registered evidence records are retained for a minimum of 5 years from the date of registration, subject to our data retention policy.
8. Intellectual Property
ProofSafe, its logo, name, and all software, designs, and content within the App are owned by LinksGroups Engine and protected by copyright and other intellectual property laws.
You retain full ownership of all evidence, photos, videos, documents, and notes you create using ProofSafe. We do not claim any ownership over your content.
9. Disclaimer of Warranties
ProofSafe is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be error-free, uninterrupted, or free from security vulnerabilities. Use of the App is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by applicable law, LinksGroups Engine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of evidence, loss of data, loss of profits, or legal costs arising from your use of ProofSafe.
Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Changes to the Service
We reserve the right to modify, suspend, or discontinue any part of ProofSafe at any time. We will endeavour to provide reasonable notice of significant changes. Continued use of the App after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws in your country provide otherwise.
